Terms and conditions
For the purchase of digital products (PDF files to download).
§ 1 Scope
These terms apply to all contracts you conclude with Tom Schneider ("we") through this site. Different terms apply only if we expressly agree to them. A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their self-employed professional activity (Section 13 BGB).
§ 2 Subject of the contract
We sell digital products, in particular calendars and planners as PDF files to download. Content, functions and technical requirements (for example suitable PDF or note-taking apps) are given in the respective product description. A free preview shows structure and design before you buy. Printed or other physical products are not included.
§ 3 Conclusion of the contract
The presentation of the products is not a binding offer. By clicking the order button you make a binding offer to buy. Before that, you can check and correct your entries at any time. The contract is concluded when we confirm the order by email or provide the product. We store the contract text and send it to you with the confirmation; you can view the terms on this page at any time. The contract language is German.
§ 4 Prices and payment
Stripe handles the payment as the merchant and calculates the tax of your country. You therefore see the exact price at checkout, before you pay. There are no shipping costs.
The available payment methods are shown during the order process. The purchase price is due when the contract is concluded.
§ 5 Provision
After receipt of payment, we make the product available immediately as a download and send you the link by email. Please save the file; the link may expire after a reasonable period.
§ 6 Right of withdrawal
As a consumer you have a statutory right of withdrawal; the details are in the withdrawal information. For digital content it expires as soon as we begin providing it, provided you have expressly agreed beforehand that we begin performance before the withdrawal period has expired, have acknowledged that you thereby lose your right of withdrawal, and we have confirmed the contract to you on a durable medium (Section 356 (5) BGB).
§ 7 Rights of use
You receive a non-exclusive, unlimited-in-time, non-transferable right to use the product for your own private purposes, to store it on your devices and to print it for yourself. Passing on, reselling, publishing or commercially using the file or edited versions of it is not permitted unless we have agreed in writing. Third-party rights in included typefaces, data and symbols remain unaffected; they are listed on the sources page of each product.
§ 8 Warranty
The statutory rights for defects in digital products apply (Sections 327 et seq. BGB). Please report errors by email; we will then provide a corrected file.
§ 9 Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act. In the event of slightly negligent breach of essential contractual obligations (obligations whose fulfilment makes performance of the contract possible in the first place and on which you can regularly rely), liability is limited to the foreseeable damage typical for this type of contract. Otherwise, liability for slight negligence is excluded. We calculate public holidays, school breaks and sun, moon and sky data carefully from public sources, but give no guarantee for them.
§ 10 Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law applies only insofar as it does not deprive you of the protection of mandatory provisions of the state in which you have your habitual residence. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. Should a provision be invalid, the rest of the contract remains valid.
